1. GENERAL PROVISIONS
The website www.casatimis.ro is provided by DOMENIUL CASA TIMIS S.R.L. (hereinafter referred to as ,,Casa Timis’’/ ,,the Resort’’), based in Chiţorani, Bucov Village, Florica Romalo 4 Street, Prahova County, registered at National Trade Register Office with the number J29/894/2022, having the Unique Registration Code 45910456.
These Terms and Conditions are applied in the context of making reservations and purchasing touristic services through the www.casatimis.ro platform, within the Casa Timis accommodation unit.
Browsing the www.casatimis.ro website, along with making a reservation or purchasing gift cards is equivalent to reading, understanding and fully accepting the Terms below by any Customer of the Resort as a Consumer.
Casa Timis reserves the right to change the content of the website, as well as the present Terms and Conditions, without any prior notification to the Consumers. In case of divergence or misunderstandings between Casa Timis and the Consumer, the Terms and Conditions valid when the Consumer accepted them will be applied.
”Platform/ Site’’ – the online platform www.casatimis.ro;
”Document” – the present version of Terms and Conditions;
”Content” includes the following:
”Consumer” – the person who navigates the Site or interacts, in any way, with it and has access to the Content;
”Distance contract” – according to the definition included in romanian legislation, in GEO no. 34/ 2014 regarding consumer rights in contracts concluded with professionals, the distance contract represents any contract concluded between a professional and a consumer within a distance sales or service provision system organized without the simultaneous physical presence of the parts, with the exclusive use of one or more means of remote communication, up to and including the moment when the contract is concluded;
”Personal data” – any information regarding an identified or identifiable person (”data subject”). It includes (non-exhaustive list): name and surname, e-mail adress, telephone number etc.;
”Personal data Controller” – means the person or company, public authority, agency or other legal entity that, alone or with others, establishes the purposes and means of personal data processing. Regardind the website, the data Controller is represented by Casa Timis.;
”Consent” – any manifestation of the free, specific, informed and unambigous will of the data subject who accepts, through a statement or an unambigous action the fact that the personal data will be processed;
”Processing” – any operation/ set of procedures regardin personal data (with or without using automatic means), including: collection, registration, organization, structuring, storage, adaptation, modification, extraction, consultation, use, disclosure, dissemination, provision, alignment, combination, restriction, deletion, destruction, etc..
3. GENERAL POLICY
3.1. General provisions
This document establishes the terms and condition of using the Website and its content by the Consumer. The Consumer is requiered to read this document carefully in order to prevent possible unwanted/ unpleasant consequences, which may be assessed by him as having a negative impact on his data and/ or the information provided to the Resort.
The services are available through the Website www.casatimis.ro, by phone at No. +40 0723 682 568/ +40 0740 248 771 (for the Restaurant) or by sending an e-mail to firstname.lastname@example.org.
By navigating the Website, the Consumer is solely responsible for all activities arising from its use. In addition, he is responsible for any material, intellectual, electronic or any other damage caused to the Website and/ or the Content made available by Casa Timis, in accordance with the national legislation in force.
If the Consumer does not agree with these Terms and Conditions and/ or does not accept the present document, he has the possibility to send an e-mail to the electronic mailing adress: email@example.com and to specify the reasons and/ or requests to operate the intendended changes.
The consumer can retreat at any time and change his decision in order to not agree or accept the Terms and Conditions.
The client cannot retreat the agreement expressed in favor of the present document during the period of executing the contract or until the moment he pays the value of all unpaid contracts to Casa Timis and the penalties in accordance with the Policy regarding the penalties in case of cancellation/ non-attendance available in this document, as the situation requieres.
The Website name and its graphic signs are the property of Casa Timis, so these element cannot be taken over, copied or used without the written consent of their owner/ holder. The entire Content presented or displayed within the website including (but not limited to) text, graphics, images, videos, sounds and illustrations is the property of Casa Timis. All elements of the service offered by the Resort are protected by copyright, author’s rights and other regulations in the field of intellectual property rights.
The name ”Casa Timis”/”casatimis.ro”, its associated logos and symbols, as well as their combinations with any word, graphic symbol or in any other form, used on the Site, are registered trademarks and are the exclusive property of Casa Timis and cannot be used in any way by third parties without prior consent.
The consumer cannot modify any of the aforementioned materials and cannot copy, distribute, transmit, display, perform, reproduce, publish, license, create works derived from them, transfer or sell information or works contained on the website.
With the exception of actions permitted by applicable copyright law, the Consumer is responsible for obtaining permission before using any copyrighted material made available by Casa Timis.
Any Content to which the Consumer has and/or obtains access by any means is subject to the Document if the Content is not accompanied by a specific and valid usage agreement concluded between Casa Timis and the Consumer and without any implied or express guarantee from Casa Timis part reference to that Content.
The communication of any information or data in the form of a message, text, image, audio and/or video file or any other type of material, regardless of the method of publication or transmission (public or individual), by any person or legal entity, other than Casa Timis, is carried out on the sole responsibility of the person to whom these materials belong, the Company not being in any way responsible for the content or the method of publication of these communications.
If Casa Timis allows the Consumer to use, in the form described in a separate user agreement, a certain Content to which the Consumer has or obtains access following this agreement, this right extends only to that or those defined Content in the agreement, only during the existence of it or these Contents on the Site or the period defined in the agreement, according to the conditions defined in it, if they exist and do not represent a contractual commitment on the part of Casa Timis for the respective Consumer or any other third party who has/obtains access to this transferred content, by any means and that could be or is harmed in any way by this Content, during or after the expiration of the user agreement.
No Content transmitted to the Consumer, by any means of communication (electronic, by phone etc.) or acquired by him by accessing, visiting and/or viewing does not constitute a contractual obligation on the part of Casa Timis and/or the employee of the Company who mediated the transfer of Content, if it exists.
Any use of the Content for purposes other than those expressly permitted by the Document or stipulated in a separate usage agreement, if it exists, is prohibited.
The consumer is responsible for any intellectual damage caused to the Site/Content, in accordance with the Romanian legislation in force.
3.2. Contact Information
Casa Timis publishes its complete and correct identification data on the Site, so the Consumer can contact the Resort efficiently.
Accessing the Site, using the information presented within it, visiting the pages or sending e-mails or notifications addressed to the Company can be done by means of electronic communication, by phone or any other means of communication available to the parties, considering, thus, the Consumer consents, in turn, to receiving notifications from Casa Timis in electronic and/or telephone manner, including communications by e-mail or through the announcements published on the Site.
Casa Timis reserves the right not to respond to all requests of any nature, especially if they are unfounded/abusive/insulting, received by any means of communication (electronic, telephone etc.).
The consumer expressly declares that the contact data provided by sending it to the e-mail address firstname.lastname@example.org or for making a reservation belong to him (for example: first and last name, e-mail address, telephone number, etc.) and that this data will be able to be used by the Company in its communications with the Consumer, for the purpose of solving any requests, but also for the provision of additional information, at the request of the Consumer. Also, in the case of purchasing gift cards, the Consumer provides Casa Timis with truthful, complete and correct data for sending the ordered gift card and invoicing.
4. SERVICE FEES
All the service fees displayed on the webiste are expressed per night of accommodation and include breakfast, as well as the VAT rate (5%). Fees do not include hotel tax or other taxes imposed by central or local authorities.
Casa Timis reserved the right to change the rates at any time. For already confirmed reservations, the fee is a firm one so it will not be changed.
The prices increase, at a given moment, may be determined, among other things, by the increase in fees and taxes or in the case of the introduction of new fees and taxes. For already confirmed reservations, the rate will remain the one from the moment of confirmation and will not undergo changes.
Service reservations, subject to confirmation by Casa Timis, are made through the following methods:
The validity period of the reservations is 2 calendar days. For reservations in which the date of accommodation occurs less than 2 days after the reservation date, the validity period of the reservation will be mentioned in the written confirmation from the Resort.
For telephone reservations, the availability of the Resort will be checked in advance, the Client being instructed to send the reservation request by e-mail or to reserve via the website www.casatimis.ro. Based on the request e-mail, the Client will receive the proforma invoice for full payment of the stay. For more details regarding payment, please consult Section 6 – Payment and Reservation Guarantee.
6. PAYMENT AND RESERVATIONS GUARANTEE
The customer has the following payment methods available:
Reservations are considered guaranteed at the time of payment confirmation.
In case of reservations made by phone or e-mail, the reservation is guaranteed by paying the entire stay in advance by the Customer, within 3 days from the date of issuing the proforma invoice. Otherwise, the reservation will be canceled automatically.
In the case of reservations made through the online reservation platform on the website www.casatimis.ro, the guarantee of the reservation is made via online payment, after checking the card data entered in the reservation form, with full retention of the amount of the stay.
The rest of the payment related to the stay (for example, mini-bar consumption), if applicable, is paid upon arrival, by any payment method available.
The customer has the obligation to check the details of the invoice before paying for the services. Making the payment by the Client has the value of an express confirmation of the related invoice, any subsequent request for modification not being taken into account by the Resort.
The customer is solely responsible for the veracity of the data entered in the invoicing section of the booking form, Casa Timis having no responsibility for the veracity of the information received and used in issuing the invoice.

At the time of accommodation, the Client will be asked to present a debit/ credit card as a guarantee. If the Client does not want to guarantee with a debit/ credit card, he will pay the amount of 200 lei/ room/ stay as a guarantee deposit. This amount will be returned at the end of the stay, in the event that various situations do not occur (damages, shortages in the room inventory, mini-bar consumption, etc.).
8. CHANGES. CANCELLATION. NON-ATTENDANCE. PENALTIES
Any modification and/ or cancellation of the reservation of the services, at the initiative of the Client, shall be sent in writing to the e-mail address: email@example.com or by phone, no.: +40 0723 682 568. Any change related to the offered services are subject of the prior approval of the Resort.
The reserved services can be canceled as follows:
Non-attendance is the situation in which the Client, following a confirmed and uncancelled reservation in one of the previously mentioned ways, does not show up at the Resort on the date for which the reservation was made. In this case, the amount paid as an advance will be retained in full.
In the case of shortening the stay announced by the Clients during the stay, Casa Timis reserves the right to retain, as damages, the value of the services not consumed.
9. CHECK-IN & CHECK-OUT
Check-in starts at 4:00 p.m. For check-in, you will be requested to present a valid identity document and to complete the arrival announcement form.
Rooms are vacated by 12:00 at the latest.
At the request of the Clients and when Casa Timis has accommodation spaces, the room release time can be exceeded by no more than 6 hours, against a rate of 50% of the value of one night’s accommodation without breakfast, according to the fee displayed at the reception.
Accommodation for children up to 6 years old is free, for children between 7-12 years old, 50% of the value of a bed will be charged, with or without the provision of an extra bed in the room, and for children over 12 years old, the normal rate will be charged.
10. RESTAURANT/ BAR/ ENGLISH BAR:
The working hours of the Restaurant “Casa TIMIS”/wine cellar are 11:00 a.m. – 11:00 p.m.
Breakfast is served daily between 8.00 and 10.00.
Meal services will be provided at the prices valid on the date of the stay.
The entertainment program will take place according to the existing notices on the website or at the reception of Casa Timis.
Inside the dining areas, access is only allowed with decent clothing.
Access to Casa Timis premises with food and drinks from outside is strictly prohibited.

Smoking is strictly prohibited inside Casa Timis, excepting the spaces specially set up for this purpose.
12. PARKING FACILITIES
Casa Timis offers free supervised parking with a capacity of 25 parking lots.
13. SAFETY. SECURITY. SPECIAL NEEDS.
The resorst and public spaces are monitored through video surveillance. Please consult, for more details regarding the protection of personal data the ”Information note regarding processing of personal data through the use of video surveillance” displayed at the reception.
Casa Timis is not hold responsible for forgotten, lost or allegedly stolen items within the Resort.
Casa Timis does not assume responsability for any accidents that may occur as a result of improper use of the Resort’s facilities.
Most of the spaces in the Resort are accessible to people with disabilities. If you have a special need, of any kind, please let us know in advance.
Pets are not allowed inside Casa Timis.
Casa Timis has the right to refuse accommodation to Customers accompanied by pets, with the application of a penalty in the amount of 100% of the value of the first night’s accomodation.
Visitor access is allowed between 11:00 a.m. and 10:00 p.m., without additional costs, and between 10:00 pm and 11:00 a.m. access is allowed only by registratration at the reception and by paying the fees.
16. ENVIRONMENTAL PROTECTION & TIDINESS
Environmental protection is a permanent concern of the Resort.
The bed linen is changed after 2 days of accommodation or at the request of the Client, and the towels are changed daily or at the request of the Client.
To signal the desire to change linen and towels, Customers are asked to leave them on the floor in the bathroom.
17. BEHAVIOUR AND RESPONSABILITIES
Casa Timis reserves the right to refuse accommodation or service in the restaurant to Customers who are under the influence of alcohol or prohibited substances, rude or turbulent who, through their attitude, damage the Restort’s image or disturb other Customers.
Complaints regarding the quality of the tourist services provided can be made on the spot, during the entire stay, at the reception level or by sending an e-mail to the address: firstname.lastname@example.org. Complaints after the cancellation can be made via e-mail address email@example.com. Complaints that could only be remedied during the stay will not be considered later.
Complaints regarding the theft, destruction or damage of the goods brought by the Client to the Resort must be brought to the attention of the Resort within no more than 24 hours from the date on which the Client became aware of the theft, destruction or damage.
19. DISPUTE RESOLUTION
Any dispute with reference to the Document that may appear between the Client and Casa Timis will be resolved amicably. If the amicable resolution of the conflict will not be possible within 30 days from the registration of the complaint, it will be resolved by the competent court according to the provisions of the Code of Civil Procedure.
If any of the above clauses will be found null or invalid, regardless of the cause, this clause will not affect the validity of the other clauses of this Agreement.
Casa Timis is not responsible for any loss, costs, lawsuits, claims, expenses, etc., if these are directly caused by non-compliance with the Terms and Conditions.
20. PROTECTION OF PERSONAL DATA
21. FINAL PROVISIONS
Casa Timis reserves the right to make any changes to the provisions of this Document, as well as any changes to the Site/its structure, including changes that could affect the Site and/or any Content, without prior notification to the Consumer in this sense.
Casa Timis cannot be held responsible for any errors that may appear on the Site for any reason, including changes, settings, etc., which are not made by the Site administrator.

This document of agreement between the parties was drawn up in accordance with the legislation applicable on the territory of Romania.
